Indecent/Aggravated Indecent Exposure - Macomb County

Facing an Indecent Exposure or Aggravated Indecent Exposure charge is always stressful, but it’s generally better to have to do so in Macomb County rather than somewhere else. In the real world, anyone charged with this Offense hires a Lawyer to make things better, and that means, more than anything else, avoiding Jail time and protecting your Record. I can do that.

In more than 2 decades of being a Criminal Defense Lawyer, I have kept every Indecent Exposure and Aggravated Indecent Exposure Client from being incarcerated, no matter where their case has been. Beyond Jail or Prison, however, there are a million other consequences that an Indecent Exposure charge can bring. I can make sure you avoid those, and this incident doesn’t adversely affect your future or otherwise “haunt” you, and hinder things like your ability to get and hold a job. Keeping an Indecent Exposure charge off your Record, or otherwise minimizing the impact to your Record is critical.

There are 2 kinds of Indecent Exposure charges:

The first is sometimes simply called “Indecent Exposure.” The Crime of Indecent Exposure is a Misdemeanor, punishable by up to 93 days in Jail, and a fine of up to $500, plus Costs. Occasionally, one might hear it called “simple” Indecent Exposure in order to differentiate it from its more serious counterpart, known as “Aggravated Indecent Exposure.”

The second, and increasingly more common charge is called “Aggravated Indecent Exposure,” and is a Felony. Aggravated Indecent Exposure carries a maximum potential penalty of up to 2 years in the State Prison, and a Fine of up to $2000.

To be considered "Aggravated," a person committing an act of Indecent Exposure must also fondle his or her genitals. In the real world, most Indecent or Aggravated Indecent Exposure charges are brought against men. Similarly, most charges of Aggravated Indecent Exposure are brought against men of otherwise good backgrounds. Many have very good jobs. In general, those who wind up facing an Indecent Exposure charge are nothing like you'd think of as a "Criminal."

In practice, I think the Courts and Judges of Macomb County have the best approach to Criminal charges in general, and to both kinds of Indecent Exposure charges in particular. That’s not to say that they’re overly lenient, but neither are they too stern, to the point of being over the top. Remember, Macomb County, at its southern end, is comprised of cities like Eastpointe, Fraser Roseville and Warren. These are solidly working class towns, with what I, at least, consider to be the perfect perspective on things. I’m biased, of course, having a working class background myself. Yet you’d be hard-pressed to find a Lawyer, representing someone in an Indecent Exposure case, who would rather face a Judge in a highly affluent jurisdiction rather than one in a more down-to-earth neighborhood.

Nor does that down-to-earth approach fade away as one moves north, to the Courts in cities like Sterling Heights, Shelby Township, Clinton Township and New Baltimore. The Judges in these Courts exemplify that same perfect balance between pedestrian and progressive that makes Macomb County my favorite in which to Practice.

In either type of Indecent Exposure case, the Judge is going to be looking for an explanation for why the incident took place. That’s not to say that most explanations for Indecent Exposure make a lot of sense, but the Judge is going to want to be able to put the it in perspective. If a guy gets caught relieving himself behind a building, or behind the dumpster, then the Judge wants to be able to admonish him for that. Similarly, if a person just “acted out” or flashed someone for shock value, the Judge will want to know that. This is where Macomb County Courts really shine. Instead of just being reactionary, and Ordering that a person get into all kinds of classes and counseling, even if it’s shown to not be necessary, the Judges here will give careful and honest consideration to what’s going on in a person’s life that made them do what they’ve done, and the likelihood that such an incident is out of character and not likely to happen again.

As a Macomb County Lawyer, I know that mindset especially well. I can protect you from offering an explanation that does more harm than good, I can keep you from being locked up, and I can capitalize on the undeniable fact that such a charge will always play out better in Macomb County than anywhere else.
