What Possible Penalties Could I Face in Michigan for an OWI?

If this is a first-time OWI offense, you could face these penalties:

  • Fines of up to $500
  • Up to 93 days of jail time

If your BAC was .17 or greater, you could be facing a “High BAC” (often called “super drunk”) charge. This enhanced 1st offense charge carries more severe potential penalties, including:

  • Fine of up to $700
  • Up to 180 days jail time
  • Mandatory completion of an alcohol treatment program
  • Court fees and costs
  • Community service for up to 360 hours
  • Driver’s license suspension for 1 year, with a restricted license allowed after 45 days, and for the next 10 and 1/2 months with mandatory BAIID (Breath Alcohol Ignition Interlock Device).
  • Vehicle immobilization

For subsequent (2nd and 3rd) offenses, the penalties are substantially more severe and include potential jail time along with mandatory driver’s license revocation (NOT suspension). These are exactly the kinds of negative consequences and penalties we need to avoid.

OWI Charge Reduced After Improper Turn Stop
Client was charged with operating while intoxicated. Client was pulled over after he made an improper turn. The officer asked Client if he had been drinking and he admitted that he had. Client’s BAC was .153.
Result: The charge of operating while intoxicated was dismissed. Client plead guilty to operating while visibly impaired.

OWI & No Insurance Dismissed — Reduced to Impaired Driving
Client was charged with operating while intoxicated and no proof of insurance. The Client was pulled over for swerving. Client admitted to drinking and failed multiple field sobriety tests. He had a BAC of .10.
Result: The charges of operating while intoxicated and no proof of insurance were both dismissed. Client plead guilty to operating while visibly impaired.

High BAC & Multiple Violations Reduced to Impaired Driving
Client was charged with operating while intoxicated with a high BAC, improper lane use, and an expired plate. Police officer smelled alcohol on Client. Client failed 5 field sobriety tests. His blood alcohol level was .215.
Result: Counts 1 and 2 were dismissed. We were able to negotiate the charges down to operating while visibly impaired and impeding traffic.
